These Seller Marketplace Terms (the “Marketplace Terms”) govern the offering, sale, purchase, and fulfillment of physical goods through the FetishFinder platform (the “Marketplace”). These Marketplace Terms are incorporated into and form part of the FetishFinder Terms of Service (the “Terms of Service”). Capitalized terms not defined here have the meanings given in the Terms of Service.
(a) These Marketplace Terms apply only to transactions involving Physical Goods sold by Sellers through FetishFinder.
(b) Transactions involving digital content, Subscriptions, pay-per-view content, tips, and other Seller Interactions that grant access to Content are governed by the Terms of Service and the Agreement Between Buyer and Seller (if applicable), not these Marketplace Terms.
(c) If there is a conflict between these Marketplace Terms and the Terms of Service, the Terms of Service prevail unless the Terms of Service state otherwise. If there is a conflict between these Marketplace Terms and a Seller’s listing terms, return policy, or other disclosures, these Marketplace Terms prevail.
In these Marketplace Terms, the following definitions apply:
“Buyer” means a User who purchases Physical Goods from a Seller through FetishFinder.
“Marketplace Earnings” means the portion of an Order Payment payable to a Seller in connection with an Order after deducting the applicable Platform Fee and applying any permitted adjustments, offsets, holds, refunds, reversals, chargebacks, and other amounts described in these Marketplace Terms.
“Marketplace Rules / Seller Guidelines” means the operational rules, requirements, and restrictions applicable to Sellers offering Physical Goods, as updated from time to time.
“Order” means a Buyer’s purchase of Physical Goods from a Seller through FetishFinder.
“Order Information” means personal information and transaction details disclosed to a Seller to fulfill an Order, including Buyer name, shipping address, and other information necessary to ship the Physical Goods and resolve Order-related issues.
“Order Payment” means the total amount paid by a Buyer for an Order for Physical Goods throughFetishFinder, including any shipping charges and applicable taxes collected at checkout (if any), before any deductions.
“Physical Goods” means tangible items offered for sale by Sellers through FetishFinder, excluding Content and digital services.
“Platform Fee” means the percentage-based fee deducted by FetishFinder from each Order Payment as described in Section 6(b).
“Seller” means a User who offers Physical Goods for sale through FetishFinder.
(a) FetishFinder provides an online platform that enables Sellers to list and sell Physical Goods and enables Buyers to purchase them. FetishFinder is not the seller of record and is not a party to any contract for the sale of Physical Goods between a Buyer and a Seller.
(b) FetishFinder does not manufacture, produce, store, warehouse, inspect, package, ship, deliver, or take possession of Physical Goods.
(c) Sellers are solely responsible for:
The accuracy of listings
Fulfillment, shipping, and delivery
Product quality and condition
Lawful sale and distribution
Compliance with all applicable laws and regulations
(d) Without limiting the Terms of Service, FetishFinder makes no warranties regarding Physical Goods, including warranties of merchantability, fitness for a particular purpose, noninfringement, or conformity.
(a) Sellers shall ensure that each listing for Physical Goods is accurate, complete, and not misleading, including descriptions, images, pricing, shipping costs, and any applicable restrictions.
(b) Sellers shall comply with all laws applicable to Physical Goods and Orders, including consumer protection laws, product safety laws, labeling laws, advertising laws, sanctions/export controls, customs laws, and tax obligations.
(c) Sellers shall not offer illegal, unsafe, counterfeit, infringing, stolen, or otherwise prohibited items. FetishFinder may restrict categories of items and may remove listings at any time.
(d) Sellers shall ship Orders within the timeframe stated in the listing or, if none is stated, within a reasonable time.
(e) Sellers shall package Physical Goods appropriately to reduce risk of damage.
(f) Sellers shall maintain reasonable records of shipment and provide tracking information to FetishFinder or the Buyer where available.
(g) Sellers are responsible for compliance with export/import and customs requirements for shipments they initiate, including accurate declarations.
(h) Sellers shall respond to Order-related inquiries in a timely and professional manner and shall provide reasonable assistance in resolving delivery issues.
(i) Sellers shall clearly disclose any return, cancellation, and refund terms applicable to Physical Goods, subject to applicable law (including any mandatory withdrawal or return rights in the Buyer’s jurisdiction).
(j) Sellers must not solicit, accept, or request payment for Physical Goods outside FetishFinder.
(k) Sellers shall indemnify FetishFinder and its affiliates for claims arising out of the Seller’s Physical Goods, listings, fulfillment, shipping, delivery, returns/refunds, or breach of these Marketplace Terms, the Marketplace Rules / Seller Guidelines, or applicable law.
(a) Buyers shall provide accurate shipping and contact information and shall promptly update any errors.
(b) Buyers shall only purchase Physical Goods where lawful in their jurisdiction and shall comply with all laws applicable to their Orders.
(c) Buyers shall cooperate reasonably with Sellers and FetishFinder to resolve delivery issues, including providing information necessary to locate shipments.
(d) Buyers must not submit fraudulent payment disputes, chargebacks, or refund requests.
(a) By placing an Order, the Buyer authorizes the applicable Order Payment and agrees to pay all amounts shown at checkout, including shipping charges and any applicable Taxes.
(b) For each Order, we will deduct a Platform Fee equal to 10% of the Order Payment for Sellers enrolled in a premium plan and 15% of the Order Payment for Sellers enrolled in a basic plan. The applicable Platform Fee will be deducted from the Order Payment before calculating Marketplace Earnings. We may change the Platform Fee by updating these Marketplace Terms (or the Terms of Service) and, where required by applicable law, providing notice.
(c) Order Payments are received and processed by third-party payment providers approved by FetishFinder. FetishFinder may share Order Information with payment processors and other service providers as necessary to process payments, prevent fraud and abuse, comply with legal obligations, and support dispute resolution.
(d) Order Payments are charged and paid out in USD unless otherwise stated at checkout. A Buyer’s payment provider may charge currency conversion or other fees.
(e) Unless FetishFinder states otherwise:
Sellers are solely responsible for determining and complying with Taxes applicable to their sale of Physical Goods, including any VAT or sales Tax obligations applicable to them.
Buyers may be responsible for duties, import Taxes, brokerage fees, or other charges assessed by the destination jurisdiction.
(f) Sellers must not solicit, request, or accept payment for Physical Goods outside FetishFinder or attempt to redirect Buyers off-platform to avoid fees or platform protections.
(a) Returns, refunds, cancellations, and withdrawal rights for Physical Goods are governed by (1) applicable law, and (2) the Seller’s stated terms disclosed to the Buyer before purchase, to the extent consistent with applicable law.
(b) Nothing in these Marketplace Terms waives or limits rights that cannot be waived under applicable law, including mandatory consumer protection rights.
(c) A Buyer should promptly contact the Seller regarding issues such as non-delivery, damage, defects, missing items, or items not as described. Sellers must respond to Order-related inquiries in a timely and professional manner and must cooperate reasonably to resolve Order issues.
(d) FetishFinder may assist with disputes between Buyers and Sellers regarding Physical Goods.FetishFinder may take actions it considers appropriate to protect the Marketplace and Users, including requesting additional information, removing listings, restricting Seller accounts, issuing warnings, and taking payment-related actions described in section 8.
(e) If a Buyer initiates a chargeback, reversal, or similar payment dispute:
FetishFinder may suspend or restrict the Buyer’s account and request supporting information.
FetishFinder may deduct the reversed amount and any related fees or costs imposed by payment providers from amounts otherwise payable to the Seller, including Marketplace Earnings, to the extent permitted by law and consistent with payment-provider rules.
Repeated or abusive chargebacks may result in account suspension or termination.
(a) Marketplace Earnings are the Order Payment minus the applicable Platform Fee, plus or minus any adjustments, offsets, holds, refunds, reversals, chargebacks, disputes, and other amounts described in these Marketplace Terms.
(b) Marketplace Earnings will be reflected in the Seller’s FetishFinder account and made available for withdrawal using the same payout methods, minimum payout thresholds, review periods, and verification requirements described in the Seller Payouts section of the Terms of Service, as applicable.
(c) Marketplace Earnings may be subject to a review period or temporary hold to account for chargebacks, reversals, fraud, disputes, non-fulfillment, prohibited items, or other risk or compliance concerns.FetishFinder may withhold, freeze, reverse, offset, or delay payouts of Marketplace Earnings where it reasonably suspects fraud, prohibited items, non-delivery, items not as described, sanctions exposure, or other unlawful activity, and may report suspected unlawful activity to relevant authorities.
(d) If a refund is issued, a chargeback is successful, an Order is canceled, or an adjustment is otherwise required, FetishFinder may deduct the applicable amount (including related fees) from Marketplace Earnings, and if insufficient Marketplace Earnings are available,FetishFinder may offset against future Marketplace Earnings or other amounts payable to the Seller to the extent permitted by law and payment-provider rules.
(e) FetishFinder may require identity, address, and beneficiary verification (including KYC/KYB/AML checks) before enabling or releasing payouts of Marketplace Earnings and on an ongoing basis. FetishFinder may suspend payout methods or restrict access to Marketplace Earnings while verification is pending or where it reasonably suspects fraud, sanctions exposure, or unlawful activity.
(f) Sellers are solely responsible for fulfillment, shipping, delivery, product condition, and compliance with applicable laws. FetishFinder does not manufacture, store, ship, or take possession of Physical Goods.
(a) FetishFinder will disclose Order Information to Sellers as necessary to fulfill Orders, including shipping and Order-related communications.
(b) Sellers shall use Order Information solely to fulfill Orders, provide customer service, handle returns/refunds/disputes, and comply with legal obligations.
(c) Sellers must not use Order Information for marketing purposes unless the Buyer has expressly consented, where required by applicable law.
(d) Sellers must not use Order Information to contact Buyers for purposes unrelated to the Order or to direct Buyers off the FetishFinder platform.
(e) Sellers shall implement reasonable safeguards to protect Order Information and retain it only as long as necessary to fulfill Orders, resolve disputes, and comply with legal obligations.
(a) FetishFinder may remove listings, restrict categories, and take actions to enforce these Marketplace Terms and the Marketplace Rules / Seller Guidelines.
(b) FetishFinder may delay, withhold, reverse, or offset payouts of Marketplace Earnings where it reasonably suspects fraud, prohibited items, non-fulfillment, items not as described, sanctions exposure, or violations of these Marketplace Terms, the Marketplace Rules / Seller Guidelines, or applicable law.
(c) FetishFinder may suspend or terminate accounts for violations, repeated disputes, excessive chargebacks, prohibited items, or conduct that creates risk for FetishFinder or Users.
(a) Sellers and Buyers are responsible for ensuring Orders comply with applicable cross-border requirements, including restricted items, sanctions, and customs rules.
(b) FetishFinder may restrict Orders in certain jurisdictions for legal, compliance, or risk reasons.
FetishFinder may revise these Marketplace Terms from time to time. Changes are effective when posted and apply to Orders placed after the effective date. Material changes may be notified as required by applicable law.
