These Marketplace Rules / Seller Guidelines (“Marketplace Rules”) apply to Sellers who list, offer, or sell Physical Goods through platform-enabled peer-to-peer marketplace features (the “Marketplace”).
These Marketplace Rules supplement, and are incorporated into, the Terms of Service, the Seller Marketplace Terms, the Acceptable Use Policy, and all other applicable platform policies. In the event of a conflict, the Terms of Service prevail; if the conflict is between these Marketplace Rules and the Seller Marketplace Terms, the Seller Marketplace Terms prevail.
The offering, sale, purchase, and fulfillment of Physical Goods through the Marketplace are governed by the Seller Marketplace Terms. FetishFinder provides marketplace tools only and is neither the seller of record nor a party to transactions between Buyers and Sellers.
Sellers are solely and fully responsible for all aspects of their listings and transactions, including:
Creating, marketing, and managing listings
Ensuring all descriptions, images, and representations are accurate and not misleading
Ensuring items are lawful to sell and ship in all applicable jurisdictions
Ensuring items comply with applicable product safety, labeling, and consumer protection laws
Fulfilling orders, including packaging, shipping, delivery, and tracking
Handling Buyer communications related to orders
Working in good faith to resolve disputes with Buyers
The platform does not guarantee sales, delivery, or Buyer satisfaction.
Buyer information shared for fulfillment (including shipping details) may be used only to fulfill Orders, provide Order-related support, and comply with legal obligations, and must not be used for marketing or other purposes without the Buyer’s express consent where required by law.
Sellers may offer only Physical Goods that are:
Lawful to sell and ship
Expressly permitted by the platform
Compliant with all platform policies and applicable law
The platform may remove any listing or restrict any category at any time.
Prohibited GoodsSellers must not list or sell any Physical Goods that are:
Illegal, regulated, or restricted under applicable law
Soiled items or items containing bodily fluids or other biohazards (including urine, feces, blood, semen, or other bodily substances)
Unsafe, hazardous, or unsanitary
Counterfeit or infringing
Recalled or subject to a safety notice
Stolen or unlawfully obtained
Featuring or depicting minors, or marketed to minors
Associated with trafficking, exploitation, prostitution, or in-person sexual services
Otherwise prohibited under the Acceptable Use Policy or any other platform policy
Attempting to sell prohibited goods may result in immediate enforcement action.
All listings must be truthful, accurate, and complete.
Sellers must not:
Misrepresent the nature, condition, authenticity, or origin of an item
Use deceptive pricing or misleading images
Imply platform endorsement or verification
Suggest or arrange in-person meetings or delivery
If an item is worn, used, or personalized, that fact and the nature of the personalization (if any) must be clearly disclosed.
In-person delivery, pickup, or meetings are strictly prohibited.
Payments are processed through platform-enabled payment tools, but the transaction remains solely between Buyer and Seller.
The platform:
Does not guarantee delivery or item condition
Is not obligated to provide refunds or resolve disputes between Buyers and Sellers
May assist with dispute intake or enforcement
Refunds, returns, and dispute outcomes are determined in accordance with the Terms of Service, the Seller Marketplace Terms, and any other applicable platform policies.
Sellers must not solicit, request, or accept payment outside FetishFinder for any Physical Goods or related services, and must not attempt to direct Buyers off the platform to avoid fees or platform protections.
The platform acts solely as a neutral intermediary and does not:
Own, manufacture, store, inspect, or ship Physical Goods
Verify listings or Seller representations
Be responsible for Sellers’ listings, fulfillment, shipping, delivery, or the condition of Physical Goods
Sellers must indemnify the platform as set out in the Terms of Service and the Seller Marketplace Terms.
The platform may:
Restrict categories or remove listings or content
Suspend or terminate Seller accounts
Withhold or reverse payouts associated with violations
Require additional verification
Enforcement actions may be taken without notice where permitted by law or where necessary to prevent harm.
The platform may update these Marketplace Rules from time to time. Continued use of the Marketplace constitutes acceptance of the updated rules.
